Terms of service
There are some simple ground rules you'll need to agree to before using Estates Hub. Playing by these rules is a mandatory part of using our application, so if you have any questions about them, please drop us a line and we'll respond posthaste.
Estates Hub agreement
By using or signing up for Estates Hub, you are agreeing to be bound by the following terms and conditions (the “Agreement”).
By marking the applicable "I have read and agree to the terms of service" checkbox, you hereby agree to the Agreement.
1. Estates Hub services
In exchange for your payment of the applicable subscription fee, you may request Estates Hub services, as described on our website at https://estateshub.co.za. We will provide the Estates Hub services in accordance with this Agreement and the other terms and conditions described on our website at https://estateshub.co.za.
2. Estates Hub account
To become a customer, you must complete an order form and create an account by providing first name, last name and company name (if applicable), email address, and any other information indicated as required. We may reject any order form or application for an account for any reason, in our sole discretion. You acknowledge that we will use the email address provided by you as the primary method for communication. You are responsible for keeping your account password secure. We cannot and will not be liable for any loss or damage arising from any failure to maintain the security of the account and password.
If you place an order and sign up for an account on behalf of your employer, your employer will be deemed to be the customer for the purpose of this Agreement, and you represent and warrant that you have the authority to bind your employer to this Agreement. Each customer is responsible for assuring that its employees, agents and subcontractors comply with this Agreement.
3. Fees
You will pay a fee for your subscription as specified in your Estates Hub order form. Fees are based on the subscription term and not actual usage. Fees paid are generally non-refundable, except as required by the South African Consumer Protection Act or otherwise stated in our refund policy.
Strict No-Refund Policy: All fees paid to Estates Hub (Pty) Ltd are non-refundable. Since our Service provides immediate access to digital tools, proprietary technology, and listing distribution, we do not offer refunds, credits, or prorated billing for any canceled subscriptions or unused features.
Portal Acknowledgment: As a technology portal, we are responsible for providing the platform "as-is." Dissatisfaction with listing performance, leads generated, or third-party platform behavior does not constitute grounds for a refund. Any exceptions to this policy are at the sole and absolute discretion of Estates Hub (Pty) Ltd management and do not waive our right to enforce this policy in the future.
Payment Disputes: All payments are processed via PayFast, PayPal, or Stripe. By using these services, you agree to their respective terms of service. Unauthorized chargebacks or payment disputes will result in the immediate suspension of your Estates Hub account. In the event of a payment failure, Estates Hub reserves the right to revoke access to all proprietary tools and HUB SYNC™ services until the account is settled in full.
4. Termination
Either party may terminate this Agreement at any time, with or without cause, effective immediately upon written or electronic notice. Upon termination of this Agreement, all rights granted to you hereunder will immediately cease, including but not limited to the right to access the Account, unless otherwise determined in our sole discretion.
5. Intellectual property rights
You agree not to provide us with any confidential or proprietary information. Each party acknowledges and agrees that the other party may freely use and otherwise commercially exploit any ideas, feedback or suggestions provided by it to the other party.
6. Disclaimers and limitation of liability of warranty
AS-IS Basis: The Services are provided on an “as-is” and “as-available” basis. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.
Service Interruptions: Estates Hub (Pty) Ltd shall not be liable for any interruptions caused by scheduled maintenance, server upgrades, or events beyond our reasonable control, including but not limited to power failures (loadshedding), telecommunications outages, or third-party API failures.
Limitation of Liability: To the maximum extent permitted by applicable law, Estates Hub (Pty) Ltd’s total liability for any claim arising out of this Agreement shall be limited to the amount actually paid by you to us during the three (3) month period immediately preceding the event.
No Consequential Loss: In no event shall we be liable for any loss of profits, loss of business opportunities (e.g., lost real estate commissions), or any indirect or consequential damages, even if advised of the possibility of such damages. Your sole and exclusive remedy for any dissatisfaction with the Service is to stop using the Service and terminate your account.
7. General provisions
This Agreement sets forth the entire agreement and supersedes any and all prior agreements, written or oral, of the parties with respect to the subject matter hereof. We reserve the right to update and change the Agreement prospectively by posting updates and changes on our website, https://estateshub.co.za. You are advised to please check the Agreement from time to time for any updates or changes that may impact you. If a significant change is made, we will provide reasonable notice by email and an opportunity to terminate this Agreement if you do not agree with the change.
The parties to this Agreement are independent contractors. Neither party is an agent, representative or related entity of the other party. Nothing in this Agreement is intended to create, nor will it be construed as creating, any exclusive arrangement between the parties to this Agreement. This Agreement does not restrict either party from entering into similar arrangements with others. Each party understands that the other party may now or in the future be involved in developing or providing competitive products or services. Neither party is liability for any failure or delay caused by any circumstance or event beyond its reasonable control.
8. User Content
You represent and warrant that you own or have the necessary licenses to all content (photos, descriptions, etc.) you upload to Estates Hub. By posting content, you grant Estates Hub a non-exclusive, royalty-free license to display and distribute that content. Estates Hub reserves the right to remove any listing that violates copyright or contains inaccurate information.
9. HUB SYNC™ Service
The HUB SYNC™ feature allows users to distribute content to third-party social media and video platforms. By using HUB SYNC™, you acknowledge and agree that:
- Third-Party Terms: You are responsible for complying with the Terms of Service and Community Guidelines of each third-party platform (e.g., Facebook, YouTube, X, TikTok, etc.).
- Account Authorization: You grant Estates Hub the authority to act as your agent in transmitting your content to these selected platforms.
- No Guarantee of Delivery: Estates Hub is not responsible for the failure of any third-party platform to display your content, nor for any account suspensions or "strikes" incurred on those platforms resulting from your content.
- Accuracy: You are solely responsible for ensuring the information synced is accurate and compliant with real estate advertising laws in your jurisdiction.
- API Tokens & Access: You agree to provide the necessary credentials (tokens/keys) or utilize OAuth for HUB SYNC™ to function. You are solely responsible for rotating, updating, or deleting manually provided API keys or tokens if they become compromised. Estates Hub is not liable for any unauthorized access to your third-party accounts or data breaches occurring on those platforms.
- Cross-Promotion: You grant Estates Hub (Pty) Ltd a perpetual license to share your listings on Estates Hub’s own social media platforms and marketing materials.
- Branding & Logos:
- Free Tier: Users on the free tier acknowledge that Estates Hub will automatically append or watermark the Estates Hub logo to all synced media.
- Paid Tier: Users on a paid subscription have the option to remove the Estates Hub logo or replace it with their own agency branding, subject to the technical constraints of the platform.
- OAuth Security: You are responsible for the security of your third-party accounts. If you suspect your social media account has been compromised, you must disconnect the service from Estates Hub immediately to prevent unauthorized posting. Estates Hub is not liable for content posted via HUB SYNC™ if your third-party account credentials have been compromised.
